An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to participate with Spring Hollow Development, LLC, to provide public sewer service in Williamson County to a development known as Silver Stream Farm (Additional Offsite), Project No. 06-SL-2, and also authorizing the acceptance by the Metropolitan Government of an easement from Spring Hollow Development, LLC, for use in public projects of the Metropolitan Government.

WHEREAS, Spring Hollow Development, LLC, has expressed a desire to provide public sewer service in Williamson County, Tennessee, to a development known as Silver Stream Farm (Additional Offsite), Project No. 06-SL-2; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has built the Mill Creek Trunk Sewer Project No. 98-SG013 anticipating participation from developers at $2,00 per connection towards the cost of the Project; and,

WHEREAS, Spring Hollow Development, LLC, has acquired certain easements for future sewer extension of the Mill Creek line; and,

WHEREAS, it is in the public interest that one of such easements be accepted by the Metropolitan Government of Nashville and Davidson County for use in public projects, initially for upstream development within the drainage basin, pursuant to Capital Improvements Budget No. 96SG001; and,

WHEREAS, Spring Hollow Development, LLC, shall be assessed $8,000 by the Metropolitan Government for the connection of four single family homes, which shall be reduced by the value of the above-referenced easement ($5,000), resulting in a net deposit of $3,000 by Spring Hollow Development, LLC, to Replacement Fund No. 47335.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. That the participation agreement with Spring Hollow Development, LLC, to provide public sewer services in Williamson County, Tennessee, to a development known as Silver Stream Farm (Additional Offsite), Project No. 06-SL-2, attached hereto and incorporated herein, is hereby approved, and the Director of Water and Sewerage Services is authorized to execute the same.

SECTION 2. That the easement described in an exhibit attached hereto and incorporated herein, be accepted from Spring Hollow Development, LLC, by The Metropolitan Government of Nashville and Davidson County for use in public projects, initially for upstream development within the drainage basin, pursuant to Capital Improvements Budget No. 96SG001.

SECTION 3. That a net amount of $3,000 from Spring Hollow Development, LLC, be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No. 47335.

SECTION 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
