ORDINANCE NO. BL2006-1186

An ordinance amending Section 15.44.050 of the Metropolitan Code of Laws amending the provisions pertaining to estimates and billing adjustments for water diverted from the public sanitary sewer system effective July 1, 2007, all of which is more particularly described herein.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Section 15.44.050 of the Metropolitan Code of Laws is hereby amended as follows:

1. By amending subsection B. by adding after the phrase "of diverted water", the phrase "for commercial and industrial customers".

2. By adding the following provision at the end of subsection B.:

"Effective July 1, 2007, the department shall implement a method for computing or estimating the amount of water diverted from the public sanitary sewerage system by residential customers based upon an average of the customer's monthly usage during the months of January, February and March. Such residential customers shall not be billed for sewerage service for the estimated amount of water diverted from the sanitary sewerage system. Notwithstanding the provisions of subsection A. of this section to the contrary, no residential customer shall be required to install an additional meter or meters for the purpose of determining the amount of water diverted from the public sanitary sewerage system in order to be eligible for a billing adjustment pursuant to this subsection."

3. By amending subsection D. by deleting the phrase "Customers requesting consideration", and substituting in lieu thereof the phrase "Customers, other than those residential customers eligible for a billing adjustment pursuant to subsection B. of this section, requesting consideration".

Section 4. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
