ORDINANCE NO. BL2006-1181

An ordinance approving the disposition of a certain parcel of property located at 3315 John Mallette Drive, known as the old Bordeaux Library, by the Director of Public Property (Proposal No. 2006M-079U-03).

Whereas, The Metropolitan Government owns a certain parcel of property identified as Exhibit A; and

Whereas, The Metropolitan Government has determined that this parcel of property is no longer needed for governmental purposes; and

Whereas, the Director of Public Property Administration is authorized to dispose of said property subject to the approval of the Metropolitan Council and the Mayor; and

Whereas, this property will be donated to Senior Citizens Inc., a nonprofit entity, for use as a senior citizens center; and

Whereas, this senior citizens center will benefit the emotional and physical well being of the Metropolitan Government's seniors; and

Whereas, this senior citizens center will serve a necessary public purpose; and

Whereas, this senior citizens center shall only be used by Senior Citizens Inc. and it shall only be used as a senior citizens center.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The Metropolitan County Council declares that the Director of Public Property is hereby authorized and directed to dispose of said property listed in attached Exhibit "A," to Senior Citizens Inc., a nonprofit entity:

Section 2. The Director of Public Property shall include a reversionary clause in the deed of conveyance which specifically says that Senior Citizens Inc. shall not transfer this property and Senior Citizens Inc. shall only use this property as a senior citizens center.

Section 3: This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
