An Ordinance amending Section 17.40.120 of Title 17 of the Metropolitan Code, Zoning Regulations, to require all modifications of planned unit developments enacted prior to 1998 that would result in a change in land use or development type beyond that permitted by the specific underlying zoning district be approved by the Metropolitan Council, all of which is more specifically described herein (Proposal No. 2006Z-148T).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended by amending Section 17.40.120 by amending subsection G.2. as follows:

1. By relettering the existing subsection h. as subsection i., the existing subsection i. as subsection j., the existing subsection j. as subsection k., the existing subsection k. as subsection l., and the existing subsection l. as subsection m.

2. By adding the following new subsection G.2.h.:

"h. There is no change in land use or development type, or modification in the number of units, beyond that permitted by the specific underlying zoning district;"

Section 2. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
