ORDINANCE NO. BL2005-924

An ordinance authorizing the acquisition of property by negotiation or condemnation for use in a public project for The Metropolitan Government of Nashville and Davidson County and specifically with relation to the construction of a new high school in the Old Hickory Boulevard & I-24 East area, for the use and benefit of the Metropolitan Nashville Public Schools (Proposal No. 2005M-217G-13).

Whereas, the Metropolitan Government is given the power by Sections 2.01(12), (5) of the Metropolitan Charter to provide for the taking and appropriation of real property within the area of the Metropolitan Government for any public purpose, when the public convenience requires it and in accordance with the provisions of Tennessee Code Annotated, Section 29-16-101 et seq., and also the power to purchase real property for any public purpose; and,

Whereas, Section 2.01 (6) of the Metropolitan Charter authorizes the government "to establish, maintain and regulate…a system of free schools"; and

Whereas, it is in the public interest that certain property, identified as part of Parcel 023.00 on Tax Map 175-00-0 and Parcel 031.00 on Tax Map 175-00-0, be acquired through negotiation or condemnation for the construction of a new high school in the Old Hickory Blvd & I-24 East area to relieve overcrowding and projected enrollment; and

Whereas, the Metropolitan Board of Education approved the acquisition of said property at its meeting on October 11, 2005.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County, Tennessee:

Section 1. The Director of Public Property Administration, or his designee, is hereby authorized to execute the necessary documents to acquire by negotiation or condemnation the properties identified as part of Parcel 023.00 on Tax Map 175-00-0 and Parcel 031.00 on Tax Map 175-00-0, and as shown on Exhibit A hereto.

Section 2. That any amendments to this ordinance shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3. This Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
