ORDINANCE NO. BL2005-921

An ordinance amending Section 16.28.040 of the Metropolitan Code of Laws to prohibit the issuance of a building permit if the applicant or property owner has been found guilty within the past twelve months of demolishing a historic structure without obtaining a preservation permit from the Historic Zoning Commission.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 16.28.040 of the Metropolitan Code of Laws be and the same is hereby amended by adding the following new subsection D.:

"D. No permit shall be issued pursuant to this chapter if the applicant or owner of the property for which the permit is sought has been found guilty within the past twelve (12) months by a court of law having jurisdiction over such matters of demolishing any building, structure or other improvement to real estate located within a historic overlay district without having been granted a preservation permit from the historic zoning commission."

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
