ORDINANCE NO. BL2005-877
An ordinance amending Section 12.72.080 of the Metropolitan Code of Laws to allow owners of stolen motor vehicles to remove their vehicles from the tow-in lot without paying a storage fee.
WHEREAS, the Metropolitan Code of Laws requires the Metropolitan Police Department to notify all owners of stolen motor vehicles upon receipt of such vehicles at the Metropolitan tow-in lot; and
WHEREAS, the Code of Laws further provides that once an owner of a stolen vehicle is notified that the owner's vehicle is at the tow-in lot, the owner has twenty-four hours to reclaim such vehicle and avoid paying a storage fee; and
WHEREAS, it is fitting and proper that the Metropolitan Code of Laws be amended to allow owners of stolen motor vehicles to reclaim their vehicles without paying a storage fee, provided the vehicle is in operable condition.
BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Section 12.72.080 of the Metropolitan Code of Laws be and the same is hereby amended by deleting subsection B. in its entirety and substituting in lieu thereof the following new subsection B.:
"B. If the
vehicle is inoperable and the owner fails to reclaim his vehicle and remove
same from the tow-in lot within twenty-four hours after being notified, the
owner shall be charged the regular storage fee from the time and date of receipt
of the automobile at the tow-in lot. If the vehicle is operable, the owner shall
not be charged the regular storage fee upon reclaiming his vehicle."
Section 2. This ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
