ORDINANCE NO. BL2005-838
An ordinance amending Section 7.08.090 of the Metropolitan Code of Laws to exempt restaurants located within the same structure as another restaurant possessing a valid retailer's "on-sale" beer permit from the minimum distance requirements for the issuance of beer permits.
BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVENRMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Section 7.08.090 of the Metropolitan Code of Laws be and the same is hereby amended by adding the following new subsection F.:
"F. Notwithstanding any other provision of this section to the contrary, a restaurant located within the same enclosed building or structure as another restaurant that is in possession of a valid retailer's "on-sale" beer permit shall be exempt from the minimum distance requirements set forth in subsection A. For purposes of this subsection, "restaurant" is defined as provided in Tennessee Code Annotated Section 57-4-102."
Section 2. That this Ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
