ORDINANCE NO. BL2005-837

An ordinance amending Section 2.104.040 of the Metropolitan Code of Laws related to the topping of trees within Davidson County.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 2.104.040 of the Metropolitan Code of Laws shall be and the same is hereby amended by deleting the provisions of subsection B. in their entirety and substituting in lieu thereof the following new provisions:

"B. It shall be unlawful as a normal practice for any individual or firm conducting tree care and removal as a business to top any tree within Davidson County. Topping is defined as the severe cutting back of limbs to stubs within the tree's crown to such a degree so as to remove the normal canopy and disfigure the tree. Trees severely damaged by storms or other causes, or certain trees under utility wires or other obstructions where other pruning practices are impractical may be exempted from this ordinance at the determination of the urban forester."

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
