ORDINANCE NO. BL2005-766

An ordinance authorizing the negotiation and acceptance of Deeds of Perpetual Channel Protection Easements for Project 04-DL-0715, Cowan Street Riverbank Protection, from the owners of Map 71-14, Parcel 387, the owners of Map 82-02, Parcel 78, and the State of Tennessee, on property abutting the east bank of the Cumberland River for protection from the Cumberland River. (Proposal No. 2004M-100U-05).

WHEREAS, the State of Tennessee, Steve Meadows, and C I Partners LLC, have offered certain easements to the Metropolitan Government to protect the existing sewer line and the river bank along the Cumberland River; and,

WHEREAS, it is in the public interest that these Deeds of Perpetual Channel Protection Easements be accepted for Project No. 04-DL-0715, Cowan Street Riverbank Protection; and

WHEREAS, Project No. 04-DL-0715, Cowan Street Riverbank Protection has been funded under Capital Improvements Budget No. 02DG0036 and Corps of Engineer No. DACW62-01-D-000, and the Metropolitan Planning Commission of Nashville and Davidson County has approved this acquisition on October 14, 2004, Proposal No. 2004M-100U-05.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The Director of Real Property Services is hereby authorized to negotiate and accept on behalf of The Metropolitan Government of Nashville and Davidson County Perpetual Channel Protection Easements as described in Exhibit A, attached hereto and incorporated herein, and in the plans for Project No. 04-DL-0715, Cowan Street Riverbank Protection, on record with the Office of the Director of the Water and Sewerage Services Department and incorporated herein, from the owners of Map 71-14, Parcel 387, the owners of Map 82-02, Parcel 78, and the State of Tennessee.. The initial project to be constructed in the easements is Project No. 04-DL-0715, Cowan Street Riverbank Protection.

SECTION 2. Negotiation and acceptance of additional or different easements on these or additional properties, for these same purposes, may be authorized by Resolution.

SECTION 3. This ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
