ORDINANCE NO. BL2005-765

An ordinance approving an Agreement between the United States Department of the Army and The Metropolitan Government of Nashville and Davidson County for the Cowan Street Streambank Protection Project in Davidson County, Tennessee and authorizing the execution of the same.

WHEREAS, the Metropolitan Department of Water and Sewerage Services provides water, sewerage and stormwater services in Davidson County, Tennessee; and

WHEREAS, the Committee on Transportation and Infrastructure of the United States House of Representatives has requested the Secretary of the Army to review the reports for the Chief of Engineering on the Cumberland River and Tributaries in the interest of environmental restoration, streambank protection, greenway and other purposes for Davidson County, Tennessee; and

WHEREAS, the Corp of Engineers has the authority and capability and is willing to fund participation in a cost sharing Streambank Stabilization Project.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: The agreement between The United States Department of the Army and The Metropolitan Government of Nashville and Davidson County for construction of the Cowan Street, Nashville, Tennessee, Streambank Protection Project, a copy of which is attached hereto and incorporated herein, , is hereby approved and the Metropolitan Mayor is authorized to execute the same.

SECTION 2: That any amendments, renewals or extensions of the terms of the agreement described in Section 1, shall be approved by Resolution of the Metropolitan Council.

SECTION 3: That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
