ORDINANCE NO. BL2005-762

An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by adding a new zoning district called "specific plan" (SP), all of which is more particularly described herein (Proposal No. 2005Z-073T).

AMENDMENT NO. 1
TO ORDINANCE NO. BL2005-762

Mr. President:

I move to amend Ordinance No. BL2005-762 by modifying as follows:

Second "Whereas"
" Delete the term "design" and substitute in lieu thereof, the term "development".

Fourth "Whereas"
" Delete the phrase "flexible design" and substitute in lieu thereof, the term "flexibility".

Section 17.08.020 "Zoning districts described" C. "SP, Specific Plan District."
" In the first sentence, delete the term "design" and substitute in lieu thereof, the term "development".
" In the second sentence, delete the phrase "flexible design" and substitute in lieu thereof, the phrase "site specific development".

Section 17.40.105 "Purpose and intent."
" In the first sentence, delete the term "design" and substitute in lieu thereof, the term "development".

Section 17.40.106 "Development Plan."
" In subsection A. "Pre-Application Conference" in the first sentence, delete the term "shall" and substitute in lieu thereof, the phrase "are encouraged to".
" In subsection B. "Application Submittal" delete the first sentence in its entirety and substitute in lieu thereof the sentence, "An applicant shall submit a rezoning application for the SP district accompanied by a development plan in a form and content established by the planning commission, along with a processing fee."
" In subsection B. "Application Submittal" in the second sentence, delete the term "design" and substitute in lieu thereof, the term "site". Also in the second sentence, delete the term "illustrations" and substitute in lieu thereof, the phrase "height and size".
" In subsection D. "Metro Planning Commission Action" delete this section in its entirety and substitute in lieu thereof,
"D. Metro Planning Commission Action. The planning commission shall review a proposed SP district application for conformance and consistency with the development plan's stated purpose and intent and the principles and objectives of the General Plan. The planning commission shall act to provide a recommendation on the application. Within ten working days of an action, the commission's resolution shall be transmitted in writing to the applicant, the metro clerk, the zoning administrator and all other appropriate governmental departments."
" In subsection F. "Changes to a SP District" delete this section in its entirety and substitute in lieu thereof,

"F. Changes to a SP District. An application to modify a SP district, in whole or in part, shall be filed with, and considered by, the planning commission according to the provisions of this section.

The metropolitan council shall approve any proposed change in the geographic boundary of a SP district, the modification of specific performance criteria, development standards, land uses, development types or other requirements as shown, described, illustrated, identified, or noted on the last council-approved development plan. These changes shall be considered by the metropolitan council according to the procedures of Article III of this chapter (Amendments to the Official Zoning Map). That portion of a SP plan being amended by the metropolitan council shall adhere to all provisions of this code."
