ORDINANCE NO. BL2005-734

An ordinance approving and authorizing the Mayor to execute a contract with the State of Tennessee Department of Transportation regarding the installation and maintenance of one or more traffic signals at SR-155 Briley Parkway at Centennial Boulevard, Exit 26 SB off ramp.

WHEREAS, the State of Tennessee, Department of Transportation ("TDOT") desires to enter into a contract with the Metropolitan Government to provide for the installation and maintenance of one or more traffic signals at SR-12 Ashland City Highway at SR-155 Briley Parkway at Centennial Boulevard, Exit 26 SB off ramp; and

WHEREAS, the terms of the contract ("Contract") attached hereto and incorporated herein by reference, provide that TDOT will install the traffic signal project, and the Metropolitan Government will maintain and provide electricity for the traffic signal project; and

WHEREAS, it is deemed to be in the best interest of the Metropolitan Government to approve the Contract with TDOT.

NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the contract between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee Department of Transportation regarding the installation and maintenance of one or more traffic signals at SR-155 Briley Parkway at Centennial Boulevard, Exit 26 SB off ramp, which contract is attached hereto and incorporated herein, is hereby approved, and the Mayor is authorized to execute the same.

Section 2. That any amendments, renewals, or extension of the terms of the Contract must be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3. That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
