ORDINANCE NO. BL2005-733
An ordinance accepting the donation of Three Thousand Dollars ($3,000) from the Nashville Downtown Partnership to the Metropolitan Government, Department of Public Works, for the installation of railings along planters located within the downtown area.
WHEREAS, Section 8.402 of the Metropolitan Charter provides that the Department of Public Works is responsible for the design, construction, maintenance, repair and cleaning of roads, highways, streets, alleys, storm sewers, other public places, bridges, viaducts, and other related structures; and
WHEREAS, as part of a pilot project, the Department of Public Works installed railings along the edge of certain planters located within the public right-of-way in the vicinity of Third Avenue North, Fourth Avenue North and Broadway; and
WHEREAS, the Nashville Downtown Partnership has offered to donate the sum of Three Thousand Dollars ($3,000) to the Metropolitan Government, Department of Public Works for use in the installation of railings along additional planters in the downtown area; and
WHEREAS, it is to the benefit of the citizens of the Metropolitan Government of Nashville and Davidson County that this donation be accepted.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the donation of Three Thousand Dollars ($3,000) from the Nashville Downtown Partnership to the Metropolitan Government, Department of Public Works, for the installation of railings along planters located within the downtown area public right-of-way is hereby accepted.
Section 2. That the sum donated shall be deposited in the appropriate fund as determined by the Director of Finance to be appropriated for the installation of railings along planters located within the downtown area.
Section 3. In the event that the funds accepted pursuant to this Ordinance are not expended for completion of the project described in Section 1 hereof within twelve (12) months from the date of the enactment of this Ordinance, said unexpended funds shall be returned to the Nashville Downtown Partnership.
Section 4. This Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
