ORDINANCE NO. BL2005-732

An ordinance authorizing the Mayor's Office Of Emergency Management to accept donations.

WHEREAS, the Metropolitan Government of Nashville and Davidson County and Greater Nashville Homeland Security District 5 will host the 2005 Emergency Preparedness Challenge on September 23-24, 2005; and,

WHEREAS, the 2005 Emergency Preparedness Challenge is a full scale local terrorism preparedness exercise for emergency responders in Davidson, Williamson, Wilson, and Sumner Counties; and,

WHEREAS, the 2005 Emergency Preparedness Challenge will involve major terrorism scenarios at multiple locations and will include all area hospitals, local responders, state and federal resources; and,

WHEREAS, the 2005 Emergency Preparedness Challenge will involve nearly a thousand first responders throughout the district and about three thousand volunteers who will act as injured patients; and,

WHEREAS, the 2005 Emergency Preparedness Challenge will test and evaluate a wide range of disaster management practices including search and rescue, mass evacuations, and mass sheltering efforts; and,

WHEREAS, the Mayor's Office of Emergency Management is responsible for administration, preparation and implementation of the 2005 Emergency Preparedness Challenge; and,

WHEREAS, in order to effectively host the 2005 Emergency Preparedness Challenge, it is necessary that the Mayor's Office of Emergency Management receive donations in the form of services, equipment, supplies, materials, and funds; and,

WHEREAS, Tennessee Code Annotated § 58-2-109 (d) authorizes the Metropolitan Government to accept through the Mayor's Office of Emergency Management donations of services, equipment, supplies, materials, and funds for emergency management purposes.

Now, therefore, be it enacted by the Council of the Metropolitan Government of Nashville and Davidson County, Tennessee:

Section 1. The Mayor's Office of Emergency Management is hereby authorized to accept donations in the form of services, equipment, supplies, materials, and funds and to use the same in the administration, preparation and implementation of the 2005 Emergency Preparedness Challenge.

Section 2. Any donations received pursuant to this Ordinance that are not expended in the 2005 Emergency Preparedness Challenge shall be used by the Mayor's Office of Emergency Management in any subsequent emergency management exercise.

Section 3. This Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
