ORDINANCE NO. BL2005-722

An ordinance abandoning an 8 inch sanitary sewer line and easement that will be replaced by an 8 inch sanitary sewer line, that is shown on Map 135, Parcels 239.01, 239.02, and 240, Project 05-SL-27, Shoppes at Nashboro, and authorizing the execution of the documents to carry out the abandonment. (Proposal No. 2005M-075U-13).

WHEREAS, an 8 inch existing sanitary sewer line and accompanying easement, more particularly described in Project No. 05-SL-27, Shoppes at Nashboro, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, a sanitary sewer line of equal size will be replacing the existing 8 inch sanitary sewer line and easement; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2002M-075U-13 on April 7, 2005 for abandonment of said easement and sanitary sewer line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the 8 inch sanitary sewer line and the easement shown on Map 135, Parcels 239.01, 239.02, and 240, Project No. 05-SL-27, Shoppes at Nashboro as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
