An ordinance authorizing the Metropolitan Government to participate with Blue Bell Creameries, L.P. , to provide public sewer service in Williamson County to Blue Bell Creameries, L.P. , Project No. 04-SL-92.

WHEREAS, Blue Bell Creameries, L.P. , has expressed a desire to provide public sewer service in Williamson County, Tennessee, to a development known as Blue Bell Creameries, L.P. , Project No. 04-SL-92; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has built the Mill Creek Trunk Sewer Project No. 98-SG-13 anticipating participation from developers at $2,000.00 per connection towards the cost of the Mill Creek Project.

WHEREAS, this project is deemed to benefit both parties and the general community and Blue Bell Creameries, L.P. agrees to pay an amount not to exceed $2,000.00 for one connection.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The participation agreement with Blue Bell Creameries, L.P. , to provide public sewer services in Williamson County, Tennessee, to the Blue Bell Creameries, Project No. 04-SL-92, attached hereto and incorporated herein, is hereby approved and the Director of Water and Sewerage Services is authorized to execute the same.

SECTION 2. That the $2,000.00 is to be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No. 47335.

SECTION 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
