ORDINANCE NO. BL2005-720

An ordinance approving and authorizing the Metropolitan Mayor to execute a cost sharing agreement for planning assistance between the United States Department of the Army and The Metropolitan Government of Nashville and Davidson County for the Cumberland Riverfront Redevelopment Plan Project.

WHEREAS, the Congress has authorized the United States of America, Department of the Army, ("Corps of Engineers") to assist the States in the preparation of comprehensive plans for the development, utilization and conservation of water and related land resources; and

WHEREAS, pursuant to the terms of the cost sharing agreement (the "Agreement") attached to this ordinance and incorporated herein, the Corps of Engineers proposes to provide planning assistance to the Metropolitan Government for the Cumberland Riverfront Redevelopment Plan Project; and

WHEREAS, approval of the Agreement will provide needed assistance for plans for the redevelopment of the Cumberland Riverfront and is in the best interests of the Metropolitan Government of Nashville and Davidson County.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Agreement between the United States Department of the Army and the Metropolitan Government of Nashville and Davidson County attached hereto and incorporated herein is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. Any amendment to the Agreement must be approved by resolution of the Metropolitan Council receiving at least 21 affirmative votes.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
