ORDINANCE NO. BL2005-716

An ordinance authorizing the acquisition of property by negotiation or condemnation for the purpose of acquiring a sanitary sewer easement for use in public project of the Metropolitan Government, initially with relation to Project No. 04-SL-69, Lakeside Cove At Percy Priest, Phase 1 (Proposal No. 2005M-126G-13).

WHEREAS, it is in the public interest that an easement be acquired to permit the constructing, maintaining, and operating a sanitary sewer and/or appurtenances within the area designated for the construction of Project No. 04-SL-69, Lakeside Cove At Percy Priest, Phase 1; and

WHEREAS, the developer, Centex, has agreed to pay the actual cost of this easement acquisition, and this easement is needed to serve properties other than this development.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. The Director of Public Property Administration, or his designee, is hereby authorized to acquire by negotiation or condemnation the following described easement for the purpose of constructing, maintaining and operating a sanitary sewer and/or appurtenances. The initial such project being Project No. 04-SL-69, Lakeside Cove at Percy Priest, Phase 1, the same being for a public purpose and the public convenience requiring it.

SECTION 2. The easement to be acquired is shown on the plans for Project No. 04-SL-69, Lakeside Cove at Percy Priest, Phase 1, on record in the Office of the Director of the Department of Water and Sewerage Services, and incorporated herein, anda list of the easement number, property address, and map and parcel number is attached hereto and incorporated herein.

SECTION 3. The Department of Water and Sewerage Services shall obtain full reimbursement of all necessary and incidental costs of the easement herein authorized to be acquired.

SECTION 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend Ordinance No. BL2005-716 by deleting Section 2 in its entirety and substituting in lieu thereof the following new Section 2:

"SECTION 2. The easement to be acquired is shown on the plans for Project No. 04-SL-69, Lakeside Cove at Percy Priest, Phase 1, on record in the Office of the Director of the Department of Water and Sewerage Services, and incorporated herein, and a list of the easement number, property address, map and parcel number, and sketch identifying the easement to be acquired is attached hereto and incorporated herein."
