SUBSTITUTE ORDINANCE NO. BL2005-713

An Ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending section 17.40.060 to prohibit the acceptance of a zoning application if the Metropolitan Government has a lien on the property or if the property owner is delinquent in the payment of property taxes (Proposal No. 2005Z-107T).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended by amending section 17.40.060 by adding the following provision at the end of subsection A.:

"No application initiated by a property owner or an agent of the property owner to amend the official zoning map or to apply a planned unit development, a neighborhood design overlay, or an urban design overlay to the property shall be accepted by the metropolitan planning commission or the metropolitan clerk if the metropolitan government has a valid lien on the property and/or if the property owner is delinquent in the payment of property taxes."

Section 2. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
