ORDINANCE NO. BL2005-712
An ordinance amending Title 17 of the Metropolitan Code, zoning regulations, by amending Table 17.12.020C MIXED USE AND NONRESIDENTIAL DISTRICTS to modify impervious surface ratio and building height standards within selected mixed-use and adopted Redevelopment Districts and by amending Section 17.24.190 to modify buffer yard standards along public alleys (Proposal No. 2005Z-105T).
WHEREAS the Metropolitan Government recognizes the importance of encouraging the continued revitalization of the City's urban neighborhoods; and
WHEREAS the Metropolitan Government also recognizes the importance of preserving and protecting the City's urban neighborhoods; and
WHEREAS the Metropolitan Government continues to refine and update the community's design standards to encourage high-quality urban development; and
WHEREAS it is necessary
to occasionally update selected provisions of the zoning regulations to accommodate
high-quality development within the City's urban neighborhoods;
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT
OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the codification of Title 17 of the Code of the Metropolitan Government of Nashville and Davidson County, Zoning Regulations, is hereby amended by changing Table 17.12.020C MIXED USE AND NONRESIDENTIAL DISTRICTS as follows:
a. Change the title
of the seventh column in the table to read "Max. height at setback line
(in ft or stories)";
b. Change the allowable maximum height at the setback line in the MUN and MUL
districts to read "3 stories";
c. Change the allowable maximum height at the setback line in the MUG and MUI
districts to read "5 stories";
d. Change the maximum ISR standard for the MUN district to .80;
e. Add the following footnote to the table: "Note 4: For properties located
within an adopted Redevelopment District an alternative standard for the maximum
allowable building height at a setback line may be established by the designated
design review authority."
Section 2. That the codification of Title 17 of the Code of the Metropolitan Government of Nashville and Davidson County, Zoning Regulations, is hereby amended by changing Section 17.24.190, subsection B. to insert the words " or alley" to the sentence.
Section 3. That this ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

By modifying Section 1, as follows:
by deleting "b" and replacing it with the following:
b. Change the allowable maximum height at the setback line in the MUN and MUL districts to read "3 stories to a maximum of 45 ft."
by deleting "c" and replacing it with the following:
c. Change the allowable maximum height at the setback line in the MUG district to read "5 stories to a maximum of 75 ft."
by adding "f" as follows:
f. Change the allowable maximum height at the setback line in the MUI district to read "7 stories to a maximum of 105 ft."
by adding "g" as follows:
g. Change the maximum ISR standard for the MUL district to .90

by deleting "e." and replacing it with the following:
e. Add the following footnote to the table: "Note 4: For properties located within an adopted Redevelopment District an alternative standard for the maximum allowable building height at a setback line may be established as part of an adopted Redevelopment District plan."
By deleting Section 2, in its entirety, and replacing it with a new Section 2 as follows:
Section 2. That the codification of Title 17 of the Code of Metropolitan Government of Nashville and Davidson County, Zoning Regulations, is hereby amended by changing Section 17.24.190 to insert subsection D as follows "When a zoning boundary falls along an alley in the urban zoning overlay district and uses on both sides of the alley are residential. In all other situations, a minimum B-5 buffer may be substituted for the required buffer."
