ORDINANCE NO. BL2005-709

An ordinance approving the disposition of a certain parcel of surplus property by the Director of Public Property listed as Williamson County Tax Map 56L, Group "D", Parcel 1.

Whereas, The Metropolitan Government of Nashville and Davidson County owns a certain parcel of property, listed as Williamson County Tax Map 56L, Group "D", Parcel 1(Exhibit A); and

Whereas, Metro Water Services acquired said parcel through a quit claim deed, as result of Metro Water Services extending a sewage line to Nolensville, Tennessee; and

Whereas, The Metropolitan Government has determined that said parcel of property is no longer needed for governmental purposes.

Now, therefore be it enacted by the Council of the Metropolitan Government of Nashville and Davidson County:

Section 1. The parcel listed as Williamson County Tax Map 56L, Group "D", Parcel 1 and owned in fee by the Metropolitan Government, is surplus.

Section 2. The Director of Public Property is hereby authorized and directed to sell said property in accordance with the Standard Rules and Regulations for the disposition of surplus real property.

Section 3. The proceeds from the sale of said parcel of property shall be credited to the General Fund of the district from whose operating budget the last department, commission, board or agency using the real property is financed.

Section 4. That the Metropolitan Government of Nashville and Davidson County retains an easement to the sewer utilities located on the property.

Section 5. That in the event there is proposed any construction over, above, or under sewer utilities in the surplus parcel of property, said construction shall require the approval of the Director of Water and Sewerage Services.

Section 6. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
