ORDINANCE NO. BL2005-700

An ordinance amending Title 17 of the Metropolitan Code, zoning regulations, by amending the Bedford Avenue Urban Design Overlay (UDO) district, to eliminate floor area ratio exemptions, to limit the size of restaurants, and to eliminate maximum building footprints, all of which is more particularly described herein (Proposal No. 2005UD-005U-10).

WHEREAS Title 17 of the Metropolitan Code of Laws allows certain standards that apply to zoning districts to be varied from by design guidelines adopted simultaneously with the application of an urban design overlay district; and

WHEREAS the Bedford Avenue Urban Design Overlay District was applied by BL2003-1380 to properties along Bedford Avenue and a portion of Crestmoor Road; and

WHEREAS, to ensure that the intended design objectives for building form, massing, and character within the Bedford Avenue Urban Design Overlay district are met;

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and is hereby amended as specifically described herein; as follows:

1. By amending the Bedford Avenue Urban Design Guidelines,

…by changing the language in "Section 2: Bulk Standards" as follows:

…delete the following:

"1. Floor Area Ratio Exemptions:

a) In Subdistrict 2, residential floor space shall be excluded from floor area used in the calculation of floor area ratio.

b) In Subdistricts 2, 3 and 4a, floor space in parking structures used to accommodate required parking shall be excluded from floor space used in the calculation of floor area ratio.",

…add the following before "2. Parking structures":

"1. Restaurant size: Restaurant, Fast-Food Restaurant, Full-Service Restaurant, Take-Out Restaurant. Establishments shall be limited to five thousand two hundred fifty square feet of gross floor area per establishment. No zoning permit shall be issued for an establishment to be used as a restaurant unless it meets this and all other applicable standards.

…by changing the "Table of Bulk Standards (continued):" as follows:

…delete "Maximum building footprint" within the "STANDARD" column,

…delete "5,250 square feet" within the "MIXED USE BLDGS" column,

…delete "5,250 square feet in Subdistrict 2" within the "OFFICE" column, and

…delete "not applicable" within the "STACKED FLATS", "LIVE-WORK", and "TOWNHOUSES" columns


Section 2. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
