ORDINANCE NO. BL2005-660

An ordinance approving and authorizing the Director of Parks and Recreation and the Director of Public Property to execute a sublease agreement with the Regional Transit Authority for a portion of Riverfront Park (Proposal No. 2005M-101U-09).

WHEREAS, the Metropolitan Government leases the property comprising Riverfront Park from the United States of America, through the Department of the Army, Corps of Engineers; and

WHEREAS, pursuant to the terms of the document attached as Exhibit A (the "Agreement") and incorporated into this ordinance, the Regional Transit Authority seeks to sublease a portion of the Riverfront Park property to construct and operate a commuter rail station and associated improvements; and

WHEREAS, the Metropolitan Government's entry into the Agreement will enhance transportation options available to area residents and yield environmental and other benefits.

NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Director of the Department of Parks and Recreation and the Director of Public Property are hereby authorized to execute the attached Agreement between The Metropolitan Government of Nashville and Davidson County and the Regional Transit Authority, as attached hereto and incorporated herein.

SECTION 2. That any amendments, renewals or extension of the terms of the Agreement must be approved by resolution of the Metropolitan Council.

SECTION 3. That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
