ORDINANCE NO. BL2005-658

An Ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Section 17.32.070 to require permanent on-premises signs to be constructed of rigid materials, all of which is more specifically described herein (Proposal No. 2005Z-080T).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended by amending Section 17.32.070, Permanent on-premises signs, as follows:

1. By relettering subsection C. as subsection D.

2. By adding the following new subsection C.:

"C. Sign construction materials. All permanent on-premises signs shall be constructed of a rigid, weatherable material such as hard plastic, wood, MDO plywood, aluminum, steel, PVC, and/or Plexiglas. On-premises permanent signs shall not be constructed of nonrigid materials including, but not limited to, vinyl, fabric, or canvas."

Section 2. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1
To
Ordinance No. BL2005-658

Mr. President:

I move to amend Ordinance No. BL2005-658 by amending Section 1 by substituting the provisions of the new subsection C. with the following new provisions:

"C. Sign construction materials. All permanent on-premises signs shall be constructed of a rigid, weatherable material such as hard plastic, wood, MDO plywood, aluminum, steel, PVC, and/or Plexiglas. On-premises permanent signs shall not be constructed of nonrigid materials including, but not limited to, vinyl, fabric, canvas, or corrugated plastic. The provisions of this subsection shall not apply to approved, permitted canopies, awnings, and porticoes."
