ORDINANCE NO. BL2005-518

An ordinance authorizing the Metropolitan Government to participate with The Jones Company of Tennessee to provide public sewer service in Williamson County to Arlington Heights Subdivision, Project No. 04-SL-152.

WHEREAS, The Jones Company of Tennessee, has expressed a desire to provide public sewer service in Williamson County, Tennessee, to a development known as Arlington Heights Subdivision, Project No. 04-SL-152; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has built the Owl Creek Trunk Sewer Project No. 97-SG-84 anticipating participation from developers at $2,000.00 per connection towards the cost of the Project; and

WHEREAS, this Project is deemed to benefit both parties and the general community, and The Jones Company of Tennessee agrees to pay an amount not to exceed $84,000.00 for a total of 42 single-family home connections.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The participation agreement with The Jones Company of Tennessee to provide public sewer services in Williamson County, Tennessee, known as Arlington Heights Subdivision, Project No. 04-SL-152, attached hereto and incorporated herein, is hereby approved, and the Director of Water and Sewer Services is authorized to execute the same.

SECTION 2. That the $84,000.00 from Jones Company of Tennessee will be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No. 67311.

SECTION 3. Amendments to this Agreement may be approved by Resolution of Council.

SECTION 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
