ORDINANCE NO. BL2005-517

An ordinance abandoning a 6-inch water line and all retained easements shown on Map 104-08, Parcel 047.00 and authorizing the execution of the documents to carry out the abandonment. (Proposal No. 2004M-065U-10).

WHEREAS, a 6-inch existing water line and accompanying easement, more particularly described in Project No. 04-WG-135, Vanderbilt/Dixie Place, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services or any other public utility; and

WHEREAS, water service to the affected property will be afforded by a new private water line of equal size; and

WHEREAS, all public utilities consented to the abandonment of any retained easements; and

WHEREAS, on August 12, 2004, the Metropolitan Planning Commission approved the abandonment of the referenced easement and water line pursuant to mandatory referral No. 2004M-065U-10.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the 6-inch water line and all retained easements, shown on Map 104-08, Parcel 047.00, Project No. 04-WG-135, Vanderbilt/Dixie Place as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
