An ordinance abandoning a 8” sewer line and easement that will be replaced by a private 8” sewer line, that is shown on Map 85, Parcel 212, Project 04-SL-116, Heartland Christian Tower, located on Fernbrook Lane, and authorizing the execution of the documents to carry out the abandonment. (Proposal No. 2004M-104U-14).

WHEREAS, a 8” existing sewer line and accompanying easement, more particularly described in Project No. 04-SL-116, Heartland Christian Tower, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, a 8” sewer line of equal size will be replacing the existing 8” sewer line and easement; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2004M-104U-14 on October 14, 2004 for abandonment of said easement and sewer line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the 8” sewer line and the easement shown on Map 85, Parcel 212, Project No. 04-SL-116, Heartland Christian Tower as indicated on the attached map, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
