ORDINANCE NO. BL2004-500
An ordinance amending Section 7.08.090 of the Metropolitan Code of Laws to prohibit the issuance of a retailer’s “off-sale” beer permit for an establishment located within one hundred feet of another establishment currently in possession of a retailer’s “off-sale” permit.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVENRMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Section 7.08.090 of the Metropolitan Code of Laws be and the same is hereby amended by adding the following new subsection F.:
“F. No retailer’s “off-sale” beer permit shall be issued to an applicant whose location is less than one hundred feet from another establishment for which a retailer’s “off-sale” permit has been issued and is currently valid.”
Section 2. That this Ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
