An ordinance amending Section 7.08.090 of the Metropolitan Code of Laws to prohibit the issuance of a permit to sell beer to an applicant that has had a prior permit for the sale of beer or liquor revoked within the past twelve month period.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 7.08.090 of the Metropolitan Code of Laws be and the same is hereby amended by amending subsection D. by deleting the phrase “ten years” and substituting in lieu thereof the phrase “the past twelve month period”.

Section 2. This Ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Ordinance No. BL2004-499

Mr. President:

I move to amend Ordinance No. BL2004-499 by deleting Section 1 in its entirety and substituting in lieu thereof the following new Section 1:

Section 1. That Section 7.08.090 of the Metropolitan Code of Laws be and the same is hereby amended by deleting the provisions of subsection D. in their entirety and substituting in lieu thereof the following new provisions:

"D. No permit shall be issued where the applicant has had revoked, within the past twelve month period, either a permit issued for the sale of beer by any board duly created within the county or municipality of this state or any license for the sale of liquor in any form by the alcoholic beverage commission of this state. Notwithstanding the foregoing provision of this subsection to the contrary, the beer board shall in its discretion, and based upon the circumstances surrounding the prior revocation, have the authority to decline issuance of a permit for up to five years after an applicant has had revoked either a permit issued for the sale of beer by any board duly created within the county or municipality of this state or any license for the sale of liquor in any form by the alcoholic beverage commission of this state."
