An ordinance amending Title 17 of the Metropolitan Code, zoning regulations, by amending Chapter 17.16 regarding the required driveway access for day care centers and day care homes (Proposal No. 2004Z-026T).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended as follows:

1. By amending Section 17.16.035 by adding the following new subsection 6.:
“ 6. Street Standard. At a minimum, a day care center shall have its driveway access on an arterial or collector street.”

2. By amending Section 17.16.170 by deleting the provisions of subsection C.1.b. in their entirety and substituting in lieu thereof the following new provisions:
“ b. Street Standard. At a minimum, driveways shall have access on an arterial or collector street.”

3. By amending Section 17.16.170 by deleting the provisions of subsection D.3. in their entirety and substituting in lieu thereof the following new provisions:
“ 3. Street Standard. At a minimum, a day care center shall have its driveway access on an arterial or collector street.”

Section 2. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
