ORDINANCE NO. BL2004-457

An ordinance abandoning a 6”and 12” water line and easements and a 8” sewer line and easement that will be replaced by a public 8” and 12”water line and a 8” public sewer line, shown on Map 82-11, Parcels 56, 72, 73, 79, 104-149, and 157, Project 04-SL-80 and 04-WL-71, Sam Levy Homes Hope VI, and authorizing the execution of the documents necessary and appropriate to carry out the abandonment (Proposal No. 2004M-067U-05).

WHEREAS, an 8” and 12” existing water line and accompanying easement and a 8” sewer line and accompanying easement more particularly described in Project No. 04-SL-80 and 04-WL-71, Sam Levy Homes Hope VI, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, a public water line of equal size will be replacing the existing 8” and 12” existing water line and accompanying easement, and a public sewer line of equal size will be replacing the existing 8” sewer line and accompanying easement; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2004M-067U-05 on August 12, 2004 for abandonment of said easement, and water and sewer lines.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the 8”and 12” water line and easement and the 8” sewer line and easement, that will be replaced by a public 8” and 12”water line and a 8” public sewer line, shown on Map 82-11, Parcels 56, 72, 73, 79, 104-149, and 157, Project No. 04-SL-80 and 04-WL-71, Sam Levy Homes Hope VI as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
