An ordinance authorizing the Metropolitan Government to participate with Mr. Thomas L. Cunningham to provide public water service in Davidson County to Dawnbrook Project No. 01-WG-67.

WHEREAS, Mr. Thomas L. Cunningham, has expressed a desire to provide public water service to a 62 lot development known as Dawnbrook (Project No. 01-WG-67); and

WHEREAS, this Project is deemed to benefit both parties and the general community, and Mr. Thomas L. Cunningham agrees to pay $2,500 for each individual lot developed.

WHEREAS, The project consists of the construction of approximately 14,000 lineal feet of 12-inch water main in Campbell Road from Brick Church Pike to approximately 1,200 feet beyond the existing pressure reducing valve (PRV) near Old Dickerson Road, complete with all appurtenances

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The participation agreement with Mr. Thomas L. Cunningham to provide public water services in Davidson County known as Dawnbrook, Project No. 01-WG-67, attached hereto and incorporated herein, is hereby approved, and the Director of Water and Sewer Services is authorized to execute the same.

SECTION 2. That the $2,500 for each lot from Mr. Cunningham will be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No. 47335.

SECTION 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
