ORDINANCE NO. BL2004-427

An ordinance amending Chapters 13.32 and 16.24 of the Metropolitan Code of Laws regarding the use of barbed wire and razor wire fencing.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 13.32.120 of the Metropolitan Code of Laws shall be and the same is hereby amended by deleting the provisions of subsection A. in their entirety and substituting in lieu thereof the following new provisions:

“A. It is unlawful for any person to erect a fence along any sidewalk in the
urban services district with barbed wire or razor wire, or a fence of any kind on which barbed
wire or razor wire is used; provided, that this section shall not be construed to prevent
anyone from stretching a single strand of barbed wire on the top of any fence over seven feet
high to prevent anyone from climbing over the same.”

Section 2. That Section 16.24.330 of the Metropolitan Code of Laws shall be and the same is hereby amended by adding the following new subsection O.:

“O. Barbed wire and razor wire fencing shall be prohibited in all residential zoning districts unless the property satisfies all of the requirements of section 17.16.330 of the metropolitan zoning code regarding the keeping of domestic animals/wildlife on the property and all necessary permits have been issued.”

Section 3. This Ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
