ORDINANCE NO. BL2004-423

An ordinance approving and authorizing the Mayor to execute a contract with the State of Tennessee Department of Transportation for reevaluation of the existing Environmental Impact Statement for a portion of the Shelby Street—Demonbreun Street corridor.

WHEREAS, the State of Tennessee, Department of Transportation (“TDOT”) desires to enter into a contract with the Metropolitan Government to provide for management, funding, and related matters for the reevaluation of the existing Environmental Impact Statement for that portion of the Shelby Street—Demonbreun Street corridor from Fourth Avenue South to I-40 West; and

WHEREAS, the terms of the contract (“Contract”) attached hereto and incorporated herein by reference, provide that twenty percent (20%) of the actual costs for the Contract’s project will be paid by the Metropolitan Government and eighty percent (80%) of the actual costs of the project will be paid from High Priority Project funds, subject to allocation by TDOT, but if the use of these funds are ruled ineligible, or if these funds are exhausted, then the Metropolitan Government will be responsible for 100% of the costs; and

WHEREAS, it is deemed to be in the best interest of the Metropolitan Government to approve the Contract with TDOT.

NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the contract between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee Department of Transportation concerning the Environmental Impact Statement for a portion of the Shelby Street—Demonbreun Street corridor, which contract is attached hereto and incorporated herein, is hereby approved, and the Mayor is authorized to execute the same.

Section 2. That any amendments, renewals, or extension of the terms of the Contract must be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3. That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
