An ordinance approving a construction agreement with CSX Transportation, Inc.

Whereas, pursuant to the terms of the construction agreement (the “Contract”) with CSX Transportation, Inc. (“CSX”), attached to this ordinance as Exhibit A, The Metropolitan Government of Nashville and Davidson County agrees to reimburse CSX for certain expenses it incurs relating to the Metropolitan Government’s incursion on and interference with CSX’s property in the course of the Metropolitan Government repairing an overpass bridge owned by the Metropolitan Government; and,

Whereas, approval of the Contract will benefit the citizens of Davidson County.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the construction agreement between The Metropolitan Government of Nashville and Davidson County and CSX Transportation, Inc., attached hereto as Exhibit A, is hereby approved.

Section 2. That any amendments, renewals, or extension of the terms of the Contract must be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3. That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
