ORDINANCE NO. BL2004-415

An ordinance abandoning an 8” sewer line and a 20’ Public Utility Drainage Easement, that is shown on Map 41-08, Parcels 50 and 51, Map 41-12, Parcels 3 and 4, of Project 04-SG-146, Bellshire Walgreen’s, and authorizing the execution of the documents to carry out the abandonment. (Proposal No. 2004M-039G-02).

WHEREAS, an 8” sewer line and a 20’ public utility drainage easement, more particularly described in Project No. 04-SG-146, Bellshire Walgreen’s, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, a private sewer line of equal size will be replacing the existing 8” sewer line and easement; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2004M-039G-02 on May 27, 2004 for abandonment of said easement and sewer line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the 8” sewer line and the easement shown on Map 41-8, Parcels 50 and 51, Map 41-12, Parcels 3 and 4, of Project No. 04-SG-146, Bellshire Walgreen’s, as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
