ORDINANCE NO. BL2004-406

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by applying the Historic Landmark Overlay District to Sunnyside at Sevier Park at 3000 Granny White Pike (20.43 acres), the City Cemetery at 4th Ave South (unnumbered), (28.24 acres), the Omohundro Water System at 1400 Pumping Station Road and 546 Cave Road (28.27), the City Reservoir at 824 West Argyle Avenue and 1401 8th Avenue South (16.96 acres), Lindsley Hall at 730 2nd Avenue South, the Trolley Barns on Rolling Mill Hill at 33 Peabody Street, (12.08), the Shelby Street Bridge, between the Gateway and Woodland Street Bridges, all of which is described herein (Proposal No. 2004Z-108U).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by changing the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:

By applying the Historic Landmark Overlay District to Sunnyside at Sevier Park at 3000 Granny White Pike (20.43 acres), as being Property Parcel No.30 as designated on Map 118 , the City Cemetery at 4th Ave South (unnumbered), (28.24 acres), as being Property Parcel No. 03 as designated on Map 105 , the Omohundro Water System at 1400 Pumping Station Road and 546 Cave Road (28.27), as being Property Parcel No. 4 and 23 as designated on Map 94, the City Reservoir at 824 West Argyle Avenue and 1401 8th Avenue South (16.96 acres), as being Property Parcel No. 84 as designated on Map 105, Lindsley Hall at 730 2nd Avenue South, as being Property Parcel No. 199 as designated on Map 93 , the Trolley Barns on Rolling Mill Hill at 33 Peabody Street, (12.08), as being Property Parcel No. 105 as designated on Map 93 the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, the Shelby Street Bridge, between the Gateway and Woodland Street Bridges all of which is described by lines, words and figures on the attached sketch, which is attached to and made a part of this ordinance as though copied herein.

Section 2. Be it further enacted, that the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet Nos. 118, 105, 94, 93, said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 3. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend Ordinance No. BL2004-406 as follows:

By replacing the following text in Section 1 of the bill: “Lindsley Hall at 730 2nd Avenue South, as being Property Parcel No. 199 as designated on Map 93,” with the following text: “Lindsley Hall at 730 2nd Avenue South, as being a portion of Property Parcel No. 199 as designated on Map 93-11, (1.43 acres),”.
