ORDINANCE NO. BL2004-387

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the Residential Planned Unit Development district located at 2303 and 2301 Cooper Lane, Cooper Lane (unnumbered), and Piedmont Avenue (unnumbered), (59.10 acres), to permit 153 total units, including 115 single family homes and 38 townhomes, all of which is more particularly described herein, (Proposal No. 97P-036U-05).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by making certain changes in the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:
By amending the Residential Planned Unit Development district located at 2303 and 2301 Cooper Lane, Cooper Lane (unnumbered), and Piedmont Avenue (unnumbered), (59.10 acres), to permit 153 total units, including 115 single-family homes and 38 townhomes, as being Property Parcel Nos. 22, 140, 149 as designated on Map 073-05 and property Parcel Nos. 3, 4, 64, and 65 as designated on Map 73-09 and Property Parcel No. 315 as designate on Map 72-12 of Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is described by lines, words and figures on the attached plan that was duly considered by the Planning Commission, and which is on file with the Metropolitan Planning Department and made a part of this ordinance as though copied herein.

Section 2. Be it further enacted, that the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No.72 and 73 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 3. Be it further enacted, that the developer shall bond, construct and complete the
following road improvements and meet the following conditions:

· A northbound left turn lane with 75 ft of storage and transition per AASHTO standards on Cooper Lane at McGavock Pike.
· A southbound left turn lane with 75 ft of storage and transition per AASHTO standards on Cooper Lane at the project access.
· Provide adequate sight distance at the project access and Cooper Lane intersections and project access at Demarius Drive.
· Dedicate required ROW along Cooper Lane frontage to provide appropriate street cross section.
· All rights-of-way (stub streets) not utilized by this development and proposed for abandonment shall be properly abandoned by Metro Council prior to the first final PUD approval.
· No development shall occur on the 24.36-acre portion of property south, or west, of Cooper Lane without re-approval as an amendment to the PUD by Metro Council.
· Prior to or in conjunction with the final PUD submittal, the applicant must include additional study of Cooper Land to explore possible traffic calming measures.

Section 4. Be it further enacted, that houses on all lots with front-loaded access must be designed with the garage behind the front facade of the house.

Section 5. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1
To
Ordinance No. BL2004-387

Mr. President:

I move to amend Ordinance No. BL2004-387 by amending Section 3 by adding the following new conditions:

· The exterior of all homes on Demarius Drive shall be 100% brick.
· The exterior of at least five of the nine homes on Cooper Lane shall be 100% brick.
· The exterior of the remaining homes in the development shall be brick, painted brick, stone, or Hardie plank.
· The applicant shall construct a ten-foot-wide paved and graded pedestrian and bicycle pathway built in conformance with the requirements of the Department of Parks and Recreation parallel to Cooper Lane along the 24.36-acre portion of the property designated for use as park land.
· Should the applicant maintain the 24.36-acre designated park land, such maintenance along the southwest side of Cooper Lane and Ravenwood Drive shall consist at a minimum of clearing out overhanging branches, removing bulk trash items, and closing off unauthorized entrances.
· Underground utilities shall be utilized for all interior connections in the development.
· The applicant shall remove the understory of vegetation along the south side of Cooper Lane for a width of twenty feet measured from the edge of the pavement.
· The applicant shall install a fence along the south side of Cooper Lane that is visible from the road at night. The fence should be erected approximately ten feet from the road measured from the edge of the pavement.
· The applicant shall install thermoplastic edge lines along the entire length of Cooper Lane on both sides of the roadway.
· The applicant shall assist with the construction of any further traffic calming measures recommended by the study.
