ORDINANCE NO. BL2004-385

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OR20 to CL district property at 7096 Old Harding Pike and a portion of property at 7121 Highway 70 South, east of Hicks Road, (1.68 acres), all of which is described herein (Proposal No. 2004Z-013G-06).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by changing the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:

By changing from OR20 to CL district property at 7096 Old Harding Pike and a portion of property at 7121 Highway 70 South, east of Hicks Road, (1.68 acres), being more particularly described as Property Parcel No. 56 and part of parcel No. 57 as designated on Map 142 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is described by lines, words and figures on the attached sketch, which is attached to and made a part of this ordinance as though copied herein.

Section 2. Be it further enacted, that the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No. 102-00 said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 3. Be it further enacted, that the change to the Official Zoning Map described in Section 1 hereof is hereby conditioned upon the following:

1. The construction of a monument style sign constructed of “municipal red brick” being a maximum eight feet in height and nine feet in length;
2. That the exterior of the proposed development be consistent with the rendering on file with the Planning Commission and made a part of this ordinance as though copied herein; and
3. That the proposed development be consistent with the Demolition and Layout Plan and the Landscape Plan filed with the Planning Commission as part of the Preliminary Planned Unit Development on file with the Planning Commission and made a part of this ordinance as though copied herein.

Section 4. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend Ordinance No. BL2004-385 as follows:

1. By amending the caption and Section 1 of the ordinance by deleting the phrase “property at 7096 Old Harding Pike and”.
2. By amending the caption and Section 1 of the ordinance by deleting “(1.68 acres)” and substituting in lieu thereof “(1.10 acres)”.
3. By substituting the sketch referenced in Section 1 with the attached new sketch.
