ORDINANCE NO. BL2004-383

An ordinance approving and authorizing the Metropolitan Mayor to execute a contract in lieu of performance bond with the Tennessee Department of Environment and Conservation regarding the Due West Dump Site.

Whereas, pursuant to the terms of the contract in lieu of performance bond (the “Contract”) with the Tennessee Department of Environment and Conservation, attached to this ordinance as Exhibit A, The Metropolitan Government of Nashville and Davidson County agrees to properly perform operation and maintenance requirements for the Due West Dump Site, and agrees to a potential penal sum of $2,091,024; and

Whereas, approval of the Contract will benefit the citizens of Davidson County.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the contract in lieu of performance bond between The Metropolitan Government of Nashville and Davidson County and the Tennessee Department of Environment and Conservation, attached hereto as Exhibit A, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That any amendments, renewals, or extension of the terms of the Contract must be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3. That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
