ORDINANCE NO. BL2004-382

An ordinance granting the Public Works Department the power and duty to manage and administer the Metropolitan Government’s participation in the Tennessee Fast Track Industrial Development Program (“FIDP”) and grants related thereto.

WHEREAS, Section 8.402 of the Metropolitan Charter provides that the Department of Public Works shall be responsible for specific tasks, as well as “such other powers and duties as are assigned to the department by this Charter or may be assigned thereto by ordinance or by action of the mayor;” and,

WHEREAS, since 1993 the Metropolitan Government has participated with the State of Tennessee, the Greater Nashville Regional Council, and private businesses in the Tennessee FastTrack Infrastructure Development Program (“FIDP”), formerly known as the Tennessee Industrial Infrastructure Program (“TIIP”); and,

WHEREAS, the Industrial Development Board and the Mayor’s Office of Economic Development have previously managed and administered the Metropolitan Government’s participation in the FIDP and related grants; and,

WHEREAS, the Public Works Departments is well-suited to manage and administer the Metropolitan Government’s participation in the FIDP and related grants.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Department of Public Works shall have the power and duty to manage and administer the Metropolitan Government’s participation in the Tennessee FastTrack Infrastructure Development Program (“FIDP”), and grants related thereto.

Section 2. That all agreements, contracts, and grants relating to the Metropolitan Government’s participation in FIDP may be approved by Resolution of Council receiving twenty-one affirmative votes.

Section 3. That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
