ORDINANCE NO. BL2004-381

An ordinance authorizing the Director of the Department of Water and Sewerage Services to enter into agreements with the State of Tennessee to certify the Department’s authority to approve water and wastewater engineering construction plans, and authorizing a fee schedule for the Department of Water and Sewerage Services to charge for review of such plans.

WHEREAS, the Metropolitan Department of Water and Sewerage Services has determined that it is to the advantage of the Department, the Metropolitan Government, and the community, for the Department to approve water and wastewater engineering construction plans, in lieu of the State of Tennessee’s approval, in order to expedite the expansion of water and sewerage services.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Director of the Department of Water and Sewerage Services is hereby authorized to execute on behalf of the Metropolitan Government the attached agreements with the State of Tennessee, Department of Environment and Conservation (Exhibits 1 & 2).

SECTION 2: That the attached schedule of fees (Exhibit 3) for review of water and wastewater engineering construction plans is hereby approved, and the Department of Water and Sewerage Services is authorized to collect the same.

SECTION 3: That all future amendments to the attached agreements with the State of Tennessee may be approved by resolution of the Metropolitan Council.

SECTION 4: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
