ORDINANCE NO. BL2004-379

An ordinance authorizing the abandonment of the existing sanitary sewer line easement for Project No. 03-SG-193 located on Map 72-02, Parcel 147.01. (Proposal No. 2003M-128U-05).

WHEREAS, Teacher’s Retirement System is the owner of real property encumbered by a sanitary sewer easement; and,

WHEREAS, portions of the existing sanitary sewer easement, on the map for Project No. 03-SG-193, 3500 Gallatin Pike, on record in the office of the Director of Water and Sewerage Services, and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility: and,

WHEREAS, the Department of Water and Sewerage Services now has no need for a portion of the easement located on Map 72-02, Parcel 147.01; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment and relocation of said sanitary sewer easement, Proposal No. 2003M-128U-05, December 11, 2003.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That 172 linear feet of the sanitary sewer easement shown on Map 72-02, Parcel 147.01, and shown on Project No. 03-SG-193, 3500 Gallatin Pike, is authorized to be abandoned. Either or both Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
