An ordinance authorizing the Metropolitan Government to participate with Centex Homes to provide public sewer service at Lakeside Cove at Percy Priest Pumping Station. Project Nos. 04-SL-69 and 04-SL-69A.

WHEREAS, Centex Homes has expressed a desire to provide public sewer service at Lakeside Cove at Percy Priest Pumping Station, (Project Nos. 04-SL-69 and 04-SL-69A); and

WHEREAS, this Project is deemed to benefit both parties and the general community, and Centex Homes agrees to pay an amount not to exceed $150,000.00.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The participation agreement with Centex Homes to provide public sewer services at Lakeside Cove at Percy Priest Pumping Station Project Nos. 04-SL-69 and 04-SL-69A, attached hereto and incorporated herein, is hereby approved, and the Director of Water and Sewer Services is authorized to execute the same.

SECTION 2. That the $150,000.00 from Centex Homes will be deposited as a maintenance fee in Water and Sewer Revenue Fund No. 67311 (BU 65525000.417504).

SECTION 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

SECTION 4. Amendments to this Agreement may be approved by Resolution of Council.
