An ordinance abandoning public utility and drainage easements on Lots 461 and 462, as shown on Map 158-04, Parcels 14 and 18, Project 04-DG-88, Sherwood Drive, and authorizing the execution of related documents.(Proposal No. 2004M-052G-10).

WHEREAS, a public utility and drainage easement, more particularly described in the plans for Project No. 04-DG-88, Sherwood Drive, on record in the department of Water and Sewerage Services and incorporated herein by reference, is no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2004M-052G-10 on June 24, 2004 for abandonment of said Public Utility and Drainage Easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the public utility and drainage easement on Lots 461 and 462, as shown on Map 158-04, Parcels 14 and 18, Project No. 04-DG-88, Sherwood Drive, indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out this abandonment.

SECTION 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
