ORDINANCE NO. BL2004-352

An Ordinance requiring all departments, boards and commissions to develop an implementation plan pursuant to Title VI of the Civil Rights Act of 1964 and requiring annual compliance reports by such departments, boards and commissions.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Chapter 2.24 of the Metropolitan Code shall be and the same is hereby amended by adopting the following new Section:

“Section 2.24.103. Title VI Implementation Plans and Annual Reports.

A. Each department, board, commission or agency of the metropolitan government subject to the requirements of Title VI of the Civil Rights Act of 1964, 42 U.S.C. § 2000d et seq., and regulations promulgated pursuant thereto, shall develop a Title VI implementation plan with participation by protected beneficiaries as may be required by law or regulations. To the extent applicable, such plan shall include Title VI implementation plans of any subrecipients of federal funds through such departments, boards commissions or agencies. Each such department, board, commission or agency shall submit annual Title VI compliance reports and implementation plan updates to the director of personnel by June 30, 2005, and each June 30 thereafter. At least once each year, the director of personnel shall publish a cumulative report of the findings and recommendations concerning compliance with the requirements of this section. The cumulative annual report shall be distributed to the mayor, each member of council, and the metropolitan clerk.

B. It is the legislative intent that any increased costs incurred by any department, board, commission or agency of metropolitan government as a result of the provisions of this section shall, to the extent legally available, be paid from federal funds available therefore.”

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
