ORDINANCE NO. BL2004-343

An ordinance authorizing the Metropolitan Government of Nashville and Davidson County to accept funds from the Tennessee Valley Authority for use and benefit of the Metropolitan Nashville Public Schools and to revise a transmission line easement transversing the southwest corner of Hobson Pike.

WHEREAS, The Metropolitan Government of Nashville and Davidson County inherited a transmission line easement transversing the southwest corner of Hobson Pike in 1949 during its acquisition of property located at 2087 Hobson Pike in Antioch (the “easement”); and

WHEREAS, the Tennessee Valley Authority wishes to update the easement by entering into a new agreement (the “Agreement”) to properly describe the location and ownership of the easement; and

WHEREAS, the Tennessee Valley Authority has agreed to provide funds to the Metropolitan Government for the use and benefit of the Metropolitan Nashville Public Schools.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. The Metropolitan Government of Nashville and Davidson County, by and through the Public Property Administration, is authorized to accept funds not to exceed $14,600.00 from the Tennessee Valley Authority.

SECTION 2. The funds referred to in Section 1 shall be appropriated to the Metropolitan Nashville Public Schools in the current fiscal year budget, Fund No. 80111000.405800.

SECTION 3. The agreement between Tennessee Valley Authority and The Metropolitan Government of Nashville & Davidson County, a copy of which is attached hereto as Exhibit A and incorporated herein, is hereby approved.

SECTION 4. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
