An ordinance approving and authorizing the Mayor to execute a contract with the State Department of Transportation for improvements to the Demonbruen Street Bridge in accordance with Federal Project No: BR-STP-3249(2).

WHEREAS, improvements are needed for the bridge on Demonbruen Street over 11th Avenue and CSX Railroad (LM 0.04); and

WHEREAS, the State of Tennessee, Department of Transportation (“TDOT”) desires to enter into a contract with the Metropolitan Government for the purpose of providing for management, funding and related matters for the necessary bridge improvements; and

WHEREAS, the terms of the contract (“Contract”) attached as Exhibit A and incorporated into this ordinance by reference, provide that twenty percent (20%) of the actual cost for the bridge improvements will be paid by the Metropolitan Government and that eighty percent (80%) of the actual costs of the project will be paid from 23 U.S.C.A. 144, Highway Bridge Reconstruction and Rehabilitation Program funds subject to allocation by TDOT; and

WHEREAS, it is deemed to be in the best interest of the Metropolitan Government to approve the contract with TDOT for the replacement or rehabilitation of the bridge on Demonbruen Street over 11th Avenue and CSX Railroad (LM 0.04).

NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the contract between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, Department of Transportation concerning Federal Project No: BR-STP-3249(2), rehabilitation or reconstruction of the Demonbruen Street Bridge over 11th Avenue and CSX Railroad (LM 0.04), which is attached hereto and made part of this ordinance, be and the same is hereby approved and the Mayor of the Metropolitan Government is authorized to execute said contract.

SECTION 2: That any amendments, renewals or extension of the terms of the Contract must be approved by resolution of the Metropolitan Council.

SECTION 3: That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
