ORDINANCE NO. BL2004-309

An ordinance authorizing the Director of Public Property, or his designee, to accept and record an easement in favor of the Metropolitan Government for use in connection with development of the Harpeth River greenway (Proposal No. 2004M-064G-06).

Whereas, the owner of a parcel of property (the “Property”) described in the document attached as Exhibit A to this ordinance has agreed to donate an easement to the Metropolitan Government for use in connection with development of the Harpeth River greenway; and

Whereas, the terms of the donation are as set forth in the easement agreement (the “Agreement”) comprising Exhibit A; and

Whereas, the citizens of Nashville and Davidson County will benefit by accepting the donated easement.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The Director of Public Property, or his designee, is authorized to accept the easement and record the Agreement (Exhibit A).

Section 2. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
